1. Validity and scope of the conditions of sale<\/h3>\n

1.1. These Terms and Conditions of Sale apply to the rights and obligations arising between the customers of the MGI Beauty e-boutique (hereinafter referred to as the Buyer) and MGI Paris O\u00dc (hereinafter referred to as MGI Beauty) when purchasing goods (hereinafter referred to as the Product\/Products).<\/span><\/h4>\n

1.2. In addition to these Terms and Conditions, legal relations arising from the purchase of Products from the MGI Beauty e-boutique shall be governed by the laws in force in the Republic of Estonia.<\/span><\/h4>\n

1.3. MGI Beauty reserves the right to make changes to the terms and conditions of sale and sale prices, and these changes will be reflected in the MGI Beauty e-boutique www.mgibeauty.ee.<\/span><\/h4>\n

2. Prices<\/b><\/h3>\n

2.1. All prices in the MGI Beauty e-boutique include 20% VAT.<\/span><\/h4>\n

2.2. The discount percentages shown are rounded to the nearest whole number.<\/span><\/h4>\n

3. Placing orders<\/b><\/h3>\n

3.1. It is possible to buy products from the MGI Beauty e-boutique that have an “Add to cart” button. You must add them to your shopping cart to order the appropriate product.<\/span><\/h4>\n

3.1.1. Products intended for professional use can only be purchased by MGI Beauty`s registered and MGI Beauty approved business customers.<\/span><\/h4>\n

3.2. Product prices and availability are subject to change without notice.<\/span><\/h4>\n

3.2.1. Out of stock is displayed on the Product page with the notification “Out of stock”.<\/span><\/h4>\n

3.2.2. The price of the products is shown on the Product page, and in the case of a promotional price, both the promotional price and the regular price are reflected.<\/span><\/h4>\n

3.3. Buyers can view the contents of their shopping cart by clicking on the “Shopping Cart” icon at the top of the e-boutique page.<\/span><\/h4>\n

3.3.1. The quantity of Products in the shopping cart can be changed by typing the desired number of Products in the quantity field or by using the +\/- buttons.<\/span><\/h4>\n

3.3.2. Products can be removed from the shopping cart by clicking on the “cross” in the same row.<\/span><\/h4>\n

3.4. to place an orderYou must first select the appropriate delivery method.<\/span><\/h4>\n

3.4.1. We use Itella smartpost parcel service to deliver parcels. more information about parcel delivery can be found here<\/a>. <\/span><\/h4>\n

3.5. To place an order, you must click on the “go to pay” button.<\/span><\/h4>\n

3.5.1. If you are a registered user of the MGI beauty e-boutique, log in to your account.<\/span><\/h4>\n

3.5.2. If you are ordering Products for the first time, enter your billing details .<\/span><\/h4>\n

3.5.3 To confirm the order, select the delivery method and payment method.<\/span><\/h4>\n

3.6. To confirm your order, press the “place order” button.<\/span><\/h4>\n

3.6.1. you will then be directed to the bank of your choice to pay.<\/span><\/h4>\n

3.6.2. An order confirmation will be sent to the buyer’s e-mail address.<\/span><\/h4>\n

3.6.2. the history of orders can be viewed by a registered user under “Your orders”.<\/span><\/h4>\n

3.7. The products will be shipped by MGI Beauty after payment of the invoice.<\/span><\/h4>\n

3.7.1. if you come to pick up the products yourself, you must call in advance to arrange a day and time.<\/span><\/h4>\n

4. Entry into force of the sales contract<\/b><\/h3>\n

4.1. The buyer will be bound to the order and the payment after clicking on the “place order” button.<\/span><\/h4>\n

4.2. The sales contract shall be deemed to be concluded from the date of receipt of the advance payment following the confirmation of the order in the current account of MGI Beauty.<\/span><\/h4>\n

5. Delivery and delivery of products<\/b><\/h3>\n

5.1. After the sales contract enters into force (payment of the advance payment invoice by the Buyer), MGI Beauty will bundle the order and hand it over to MGI Beauty’s logistics partner for delivery. <\/span><\/h4>\n

5.2. It takes up to 5 working days to deliver your order.<\/span><\/h4>\n

5.2.1. In the event that for any reason the shipment is delayed, MGI Beauty Customer Support will agree with the Buyer on a suitable delivery time. <\/span><\/h4>\n

5.3. To ensure a smooth delivery, the Buyer must carefully check the information entered for delivery.<\/span><\/h4>\n

5.4. The Buyer may, in the event of non-conformity of the Product with the terms of the contract:<\/span><\/h4>\n

5.4.1. refuse to comply with your order or the obligation owed;<\/span><\/h4>\n

5.4.2. claim damages, a reduction in price;<\/span><\/h4>\n

5.4.3. claim interest for late payment in the event of delayed performance of a financial obligation by MGI Beauty.<\/span><\/h4>\n

5.4.4. Products, but not the Product packaging, damaged in transit will be replaced to the Buyer;<\/span><\/h4>\n

5.4.5. if the Goods cannot be replaced, the Buyer will be reimbursed the cost of the Goods.<\/span><\/h4>\n

5.5. MGI Beauty shall not be liable for any delay in the delivery of the Products if the Products have been delivered to the logistics partners on time, but the delay in delivery is due to circumstances beyond MGI Beauty’s control or foreseeable control.<\/span><\/h4>\n

6. Right of withdrawal<\/b><\/h3>\n

6.1. Products purchased from the MGI Beauty e-boutique are subject to a 14-day right of return from the date of receipt. If the Product ordered from the e-boutique is not suitable for the Buyer, the Buyer may return it without giving any reasons.<\/span><\/h4>\n

6.1.1. The withdrawal period shall expire 14 days after the day on which the Buyer or a third person other than the carrier and appointed by the Buyer has taken physical possession of the Goods.<\/span><\/h4>\n

6.2. No right of withdrawal:<\/span><\/h4>\n

6.2.1. goods which, by their very nature, cannot be returned and which have been delivered in closed packaging, but which have been opened by the customer;<\/span><\/h4>\n

6.2.2 goods which, once opened, would not be suitable for return for health or hygiene reasons;<\/span><\/h4>\n

6.2.3 for goods for which MGI Beauty is unable to identify the unopening of the packaging or the non-use of the goods (e.g. the goods do not have foil\/film around the cap);<\/span><\/h4>\n

6.2.4 to a Product manufactured in accordance with the terms and conditions provided by the Buyer;<\/span><\/h4>\n

6.2.5 to a product which is mixed or combined with another product or good in such a way that they can no longer be separated;<\/span><\/h4>\n

6.2.6 to a product which has been used for commercial and professional purposes.<\/span><\/h4>\n

6.3. In case of returning the Goods, MGI Beauty shall refund the Buyer the value of the returned Goods immediately, but no later than 14 days from the day MGI Beauty becomes aware of the Buyer’s decision to return the Goods. In order to return the Product, the Buyer must fill in a Return of Product Application.<\/span><\/h4>\n

6.3.1. The cost of returning the goods is borne by the buyer, unless the reason for returning the goods is that they do not correspond to what was ordered (e.g. they are wrong or defective).<\/span><\/h4>\n

6.4. The Buyer must return the Product to MGI Beauty without undue delay, but no later than 14 days after the day on which the Buyer notified MGI Beauty of the wish to return the Product. The product can be returned:<\/span><\/h4>\n

6.4.1. MGI Beauty boutique, Riia 20a-1, Tartu;<\/span><\/h4>\n

6.4.2. MGI studio, Riia 20a-1, Tartu;<\/span><\/h4>\n

6.4.3. A parcel machine, the location of which has been previously agreed between the Buyer and MGI Beauty;<\/span><\/h4>\n

6.5. The time limit is deemed to have been observed if the Buyer returns the Product before the end of the 14-day period.<\/span><\/h4>\n

6.6. MGI Beauty shall have the right to refuse to make refunds until MGI Beauty has received the returned Product or the Buyer has provided MGI Beauty with proof that he has returned the Product, whichever occurs first.<\/span><\/h4>\n

6.7. If the Buyer wishes to avoid compensation for the reduction in value of the Product, the Product must be used and tried on as it would be in a normal shop, and the Product must be returned in its original packaging and in its original condition (including all items in the product packaging and any gifts included by MGI Beauty). If the Buyer uses the Goods more than is necessary to ascertain the nature and functioning of the Goods, or fails to return the Goods in their original packaging and in their original condition, the Buyer shall be liable for any diminution in the value of the Goods.<\/span><\/h4>\n

6.7.1. In the event of deterioration of the Product to be returned, the Buyer shall be liable for the reduction in value of the Product due to the use of the Product, if he has used the Product in a manner other than that necessary to ascertain its nature, characteristics and performance. In order to ascertain the nature, characteristics and performance of the Product, the Buyer may handle and use it only as he is normally permitted to do in a shop.<\/span><\/h4>\n

6.8. MGI Beauty has the right to submit claims to the Buyer due to a decrease in the value of the Product no later than one month after the return of the Product.<\/span><\/h4>\n

6.9. If the Buyer has used or tried the Product to be returned in a way other than what would normally be allowed in a shop, or has used the Product more than is necessary to ascertain its nature, characteristics and performance, the Buyer shall be liable for any reduction in the value of the Product and MGI Beauty shall be entitled to deduct this amount from the purchase price to be returned. If the Buyer does not agree with the decrease in value indicated by MGI Beauty, he has the right to have it determined by an independent expert. The costs of the independent expert will be paid by the party whose opinion is not substantiated. If it proves impossible to identify such a party, the costs of the expert opinion shall be shared equally between the Buyer and MGI Beauty.<\/span><\/h4>\n

6.10. If it turns out that the Buyer has not received the ordered Product, the Product does not correspond to the description in the e-shop or the Product is defective, the Buyer does not have to submit a withdrawal within 14 days, but may exercise the statutory right to lodge a complaint.<\/span><\/h4>\n

7. Use of the purchased Product for commercial or professional purposes (including by a legal person).<\/b><\/h3>\n

7.1. If the purchased Product has been used for commercial or professional purposes or if the purchaser has been a legal person, the normal complaints procedure does not apply. In these cases, the time limit for lodging a complaint is usually 6 months or more, if the manufacturer has so agreed. During this period, the Product will be replaced in the event of defects on the part of the manufacturer.<\/span><\/h4>\n

8. Liability and complaints procedure<\/b><\/h3>\n

8.1. MGI beauty and the Buyer shall be liable to the other party for any damage caused to the other party by breach of these Terms and Conditions in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.<\/span><\/h4>\n

8.2. MGI Beauty shall be liable for any non-conformity or defect of the Product sold to the Buyer, which already existed at the moment of delivery of the Product to the Buyer. <\/span><\/h4>\n

8.3. The Buyer has the right to submit a claim to MGI Beauty in case of a Product not in conformity with the terms of the contract within two years from the date of delivery of the goods. The complaint must be made without delay, but not later than two months from the discovery of the defect in the Product. Upon discovery of a defect, the Buyer must take reasonable measures to preserve and protect the Product, including not using the defective Product if use of the Product will further deteriorate the condition of the Product.<\/span><\/h4>\n

8.4. In the event of non-conformity of the Product with the terms of the contract, the Buyer may invoke the remedies provided by law, including the right to demand repair or replacement of the Product. If the repair or replacement of the Product is not possible, fails or causes unreasonable inconvenience to the Buyer, the Buyer has the right to withdraw from the contract and claim a refund.<\/span><\/h4>\n

8.5. MGI Beauty shall not be liable for defects in the Product caused by the Buyer, defects resulting from improper storage or use of the Product. Defects include defects in the Product, but not in the product packaging.<\/span><\/h4>\n

8.6. If the Product is covered by a sales warranty issued by MGI Beauty or by the manufacturer, the terms of the warranty will be provided to the Buyer in writing with the Product and\/or made available electronically in the e-shop.<\/span><\/h4>\n

8.7. In order to solve any later problems, the Buyer must keep the purchase documents (invoice, contract, etc.) proving that the Product has been purchased from the MGI Beauty boutique or e-boutique. Without proof of sale, MGI Beauty may not be able to solve the problem.<\/span><\/h4>\n

8.8. In the event of a defect in a Product purchased from the MGi Beauty boutique or e-boutique, the Buyer may contact the MGI Beauty outlets within two months at the latest:<\/span><\/h4>\n

8.8.1. MGI Beauty boutique, Riia 20a-1, Tartu;<\/span><\/h4>\n

8.8.2. MGI studio beauty studio, Riga 20a-1, Tartu.;<\/span><\/h4>\n

8.8.3. or contact the e-boutique by sending an email to info@mgibeauty.ee or by calling +372 563 99 999.<\/span><\/h4>\n

8.9. When submitting a claim, the defective Product must be submitted. <\/span><\/h4>\n

8.10. When submitting a Pretension, please note:<\/span><\/h4>\n

8.10.1. Name and contact details of the buyer;<\/span><\/h4>\n

8.10.2. Date of the complaint;<\/span><\/h4>\n

8.10.3. Product shortage;<\/span><\/h4>\n

8.10.4. The requirement for MGI Beauty;<\/span><\/h4>\n

8.10.5. Reference must be made to the document proving the transaction or the guarantee, or a copy must be attached to the complaint.<\/span><\/h4>\n

8.11. MGI beauty will respond to the complaint in writing within 15 days of receipt of the complaint from the Buyer. If MGI beauty is unable to respond to the Buyer’s complaint within 15 days, it will be notified in writing, stating the reasons and the deadline by which the response will be sent.<\/span><\/h4>\n

8.12. If the Buyer and MGI Beauty are unable to resolve the dispute by agreement, the Buyer may refer the dispute to the Consumer Disputes Committee, the terms and conditions of whose procedure can be found and an application can be made here<\/a>. The Consumer Disputes Committee is competent to settle disputes arising from a contract concluded between the Buyer and an e-boutique. There is no charge for the Commission to examine the buyer’s complaint.<\/span><\/h4>\n

8.13. The buyer has the right to contact the competent supervisory authority, which is the Consumer Protection and Technical Surveillance Authority at S\u00f5le 23a, 10614 Tallinn, e-mail: info@ttja.ee. The out-of-court settlement provider for online consumer disputes under Regulation (EU) No 524\/2013 of the European Parliament and of the Council.<\/span><\/h4>\n

8.15. The buyer has the right to refer to the European Union’s consumer dispute resolution platform.<\/span><\/h4>\n

9. Unquantifiable force<\/b><\/h3>\n

9.1. MGI Beauty shall not be liable for any damage or delay in delivery of the Product if the damage or delay in delivery of the Product is due to circumstances beyond MGI Beauty’s control or foreseeable.<\/span><\/h4>\n

10. Protection and security of personal data<\/b><\/h3>\n

11. Data processing and security<\/b><\/h3>\n

11.1. All personal data of the Buyer\/Customer disclosed in the course of visiting the MGI Beauty e-boutique and making purchases will be treated as confidential information. Except in cases where the courier needs the Buyer’s\/Customer’s name, telephone number and delivery address to deliver the goods or in other cases provided for by law.<\/span><\/h4>\n

11.2. An encrypted data communication channel with banks ensures the security of the shopper’s personal data and bank details, which are also not accessible by MGI beauty e-boutique.<\/span><\/h4>\n

12. Other conditions<\/b><\/h3>\n

12.1. Product images are for illustrative purposes only.<\/span><\/h4>\n

12.2. Product prices and availability are subject to change without notice. In this case, MGI Beauty reserves the right to withdraw from the sale and to return the money to the Buyer’s current account within a reasonable period of time.<\/span><\/h4>\n

12.3. Product information is regularly checked and improved. The information may have been updated since the Buyer’s last visit.<\/span><\/h4>\n
